1. THE PROMOTION: GE STEEL AWAY SWEEPSTAKES Promotion ("Promotion") consists of nine (9) periodic sweepstakes ("Periodic Sweepstakes") and one (1) Grand Prize Sweepstakes ("Grand Prize Sweepstakes"). The Promotion starts 4/29/10 at 12:00 A.M., Eastern Time ("ET") and ends 7/7/10 at 11:59:59 P.M., ET. The specific dates for each Periodic Sweepstakes and the Grand Prize Sweepstakes are as stated in Rule 3 below.
2. HOW TO ENTER: Each day during the Promotion Period, go to www.geappliances.com (the "Website") and provide the information requested on the registration page and play the GE Steel Away Game ("Game") according to the instructions provided on the website. You will receive an entry into that week's respective Periodic Sweepstakes even if you do not successfully finish playing the Game. You do not have to play the Game to enter. Limit: One (1) entry per person per day regardless of email address used.
3. IMPORTANT DATES FOR PARTICIPATING IN THE PROMOTION: The Promotion consists of nine (9) Periodic Sweepstakes starting and ending at the times and dates as described in the table below and one (1) Grand Prize Sweepstakes. Entries from one Periodic Sweepstakes will not be carried forward to a subsequent Periodic Sweepstakes; however, all Periodic Sweepstakes entries will be entered into the Grand Prize Sweepstakes. 4. RANDOM DRAWINGS & ODDS OF WINNING: On or about the respective Random Drawing Dates listed in the table above, Mercury Promotions & Fulfillment ("Mercury"), an independent judging agency, will select the name of the potential winner of each Periodic Sweepstakes in a random drawing from among all eligible entries received for that respective Periodic Sweepstakes, and s/he will be notified by phone, e-mail or postal mail on or about the respective Notification Date listed in the table. The potential winner of the Grand Prize Sweepstakes will be selected in a random drawing by Mercury on or about 7/9/10 from among the total number of all eligible entries received throughout the Promotion Period. Mercury's decisions shall be final in all matters pertaining to this Promotion. Odds of winning a Periodic Sweepstakes depend on the number of eligible entries received in that respective Periodic Sweepstakes. Odds of winning the Grand Prize Sweepstakes depend on the total number of all eligible entries received throughout the Promotion Period.
5. PRIZES AND APPROXIMATE RETAIL VALUES ("ARV"): TOTAL OF NINE (9) PERIODIC SWEEPSTAKES PRIZES - 1 PRIZE PER EACH PERIODIC SWEEPSTAKES; ONE (1) GRAND PRIZE: (A) Periodic Sweepstakes Prize: Each winner of a Periodic Sweepstakes will receive a Two Hundred Fifty Dollar ($250) Visa® Prepaid Card (ARV: $250 each). Prepaid Cards must be used in compliance with their terms and conditions as stated at http://usa.visa.com/personal/cards/prepaid/gift_card_faq.html and as allowed by law. General Electric Company ("Sponsor") is not responsible for misplaced, lost, stolen or tampered with Prepaid Cards. (B) Grand Prize Sweepstakes Prize: The winner of the Grand Prize Sweepstakes ("Grand Prize Winner") will receive a cruise trip for two persons (2) through the Panama Canal ("Trip") consisting of roundtrip coach airfare for two persons from major international airport closest to Grand Prize Winner's residence to major airport closest to port of cruise ship's embarkation; roundtrip ground transportation between airport and port of embarkation; a ten (10) day/ nine (9) night cruise for two (2) persons through the Panama Canal in an inside stateroom (one cabin/double occupancy); and Two Thousand Dollars ($2,000) spending money. Total Approximate Retail Value of Trip: Not to exceed $8,200. If the actual retail value is less than the stated Total Approximate Retail Value, Grand Prize Winner will not receive the difference in value. All expenses not specified above, such as shore excursions and tours; ship's physicians and nurses; personal purchases or services, including but not limited to the ship's gift shops, spa, beauty salon, concessions, non-included food and beverages; mini-bar, entertainment, telephones, souvenirs, gratuities, ground transportation, insurance, personal or spa services, etc., are solely the Grand Prize Winner's responsibility. All accommodations and reservations will be as arranged by Sponsor and are subject to advance notice, holiday black-out dates and availability. Trip must be completed prior to 07/31/11. Other Trip restrictions may apply. Grand Prize Winner and travel companion must possess and present required travel documents including photo identification prior to embarkation and throughout the Trip and travel on same itinerary. Sponsor has no responsibility for lost, stolen, misplaced or mutilated tickets and/or travel documents, baggage, travel delays, or any other occurrences beyond its control. Sponsor has no responsibility for Grand Prize Winner's inability or failure to accept or utilize the Grand Prize as described herein or for the travel companion's inability to utilize the Grand Prize. The Grand Prize Winner's travel companion must be 21 years of age or older unless the Grand Prize Winner is the travel companion's parent, legal guardian or spouse. The potential Grand Prize Winner will be required to sign and return a notarized Affidavit of Eligibility/Compliance and Publicity/Liability Release, where allowed by law, and such other documents as may be reasonably requested by Sponsor. Failure to sign and return these documents by the return date specified in the prize notification will result in forfeiture of the entire Grand Prize, and, time allowing, the selection of an alternate potential Grand Prize Winner. The Grand Prize Winner's travel companion must also sign and return a Publicity/Liability Release, as allowed by law, by the stated time period. The Grand Prize Winner will be issued a Form 1099 for tax purposes in the amount of the actual retail value of the Trip and must submit his/her Social Security Number, as required by law. All federal, state and local taxes are the sole responsibility of the Grand Prize Winner. Prior to the award of the Grand Prize, Sponsor reserves the right to require the potential Grand Prize Winner to submit to a confidential background check, as allowed by law, to confirm eligibility as a condition of awarding the Grand Prize to help ensure that the use of any such person in advertising or publicity for the Promotion will not bring Sponsor & Others into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify and randomly select an alternate potential Grand Prize Winner in the event that: (a) the potential Grand Prize Winner is unreachable; (b) the Prize notification email or letter is returned as undeliverable or is not responded to; (c) the potential Grand Prize Winner fails to provide Sponsor with satisfactory proof of age, identity and residency; (d) the Grand Prize Winner fails to execute and return the Affidavit of Eligibility/Compliance (including, without limitation, providing his/her respective Social Security Number for tax purposes) or a Liability/Publicity Release and any other required documents by the specified return date, regardless of the cause of such failure; (e) the potential Grand Prize Winner declines acceptance of the Grand Prize; (f) the potential Grand Prize Winner's cannot be available to complete the trip within the time period set forth herein;(g) the results of the confidential background check are determined by Sponsor or its representative to be unsatisfactory; or (h) in Sponsor's determination, the potential Grand Prize Winner has not complied with these Official Rules. Entrants should regularly check their spam filters to ensure it does not contain any that Sweepstakes notification emails. All federal, state and local taxes are solely the responsibility of the Grand Prize Winner. NOTE REGARDING ALL PRIZES: All costs and expenses not specifically included above are solely each winner's responsibility, including all federal, state and local sales and use taxes, etc .Additionally, no Prize is redeemable for cash; nor is it transferable or substitutable except that Sponsor may, at its sole discretion, substitute a Prize or any component thereof with one of equal or greater value. Limit: A winner of one Periodic Sweepstakes is not eligible to win any other Periodic Sweepstakes nor is his/her spouse, parent, child or any individual who resides in a Periodic Sweepstakes Winner's household; however, a Periodic Sweepstakes Winner is eligible to win the Grand Prize Sweepstakes. All Prizes will be awarded provided there are a sufficient number of eligible entries.
6. ELIGIBILITY: The Promotion is open only to persons who are legal residents of, and living within, the 48 contiguous United States and District of Columbia, 18 years or older or the age of majority in their respective state of residence, whichever is greater, as of the date of entry except officers, directors, and employees (and members of their household and of their immediate families, i.e., parents, children, stepchildren, spouse, siblings and persons residing in the same household of such immediate family members) of Sponsor, its subsidiaries, affiliates, sales representatives, distributors, advertising/promotion/web design agencies including Mercury Promotions & Fulfillment, and/or their affiliates, assigns or representatives; (herein after referred to collectively as "Sponsor & Others"), and all other persons or entities associated with the development, administration, promotion, execution of, or supply to this Promotion. Residents of Alaska, Hawaii and Puerto Rico are not eligible to enter or win.
7. RELEASE: By acceptance of a Prize, each Periodic Sweepstakes Winner and the Grand Prize Winner releases the officers, directors, employees and independent contractors of Sponsor, Mercury, and their respective parent companies, subsidiaries affiliates, , divisions, dealers, distributors, suppliers, advertising and promotion agencies, and all other individuals or entities involved in the creation, administration, or fulfillment of this Promotion (all of the former collectively referred to as "Sponsor & Others"), from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Promotion, or arising out of participation in any Promotion-related activity or travel-related activity, or the receipt, use or misuse, of any Prize or Trip/activity-related thereto, whether hosted by Sponsor or a third party.
8. LIMITATIONS OF LIABILITY/INTERNET: Sponsor & Others are not responsible for interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Promotion. Sponsor & Others are not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human errors which may occur in the processing of any entries in, or administration of, this Promotion. Any entrant who attempts to play with multiple e-mail addresses, under multiple identities or uses any other device or artifice to play multiple times or to interfere with the proper play of this Promotion, will be disqualified from participation in the Promotion. Persons found tampering with or abusing any aspect of this Promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the Promotion is compromised by viruses, bugs, non-authorized human intervention or other causes, which corrupt the administration, security, fairness or intended proper play of the Promotion, Sponsor reserves the right, in its sole discretion to discontinue, modify, suspend or terminate the Promotion and proceed in a manner it deems fair and reasonable, including the selection of winners from among eligible entries received prior to such discontinuation, modification, suspension or termination. Any personally identifiable information collected during an entrant's participation in this Promotion will be collected by Sponsor and used by Sponsor and its agents solely for purposes of the proper administration and fulfillment of the Promotion as described in these Official Rules or as stated in Sponsor's Privacy Policy at http://www.geappliances.com/privacy/privacy_policy.htm. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a potential winner based on an email address, the winning entry will be deemed to have been made by the Authorized Account Holder of the email address submitted at time of entry. 9. DISPUTES: Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Michigan. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) of the appropriate Michigan State Court located in Macomb County, Michigan. Should there be a conflict between the laws of the State of Michigan and any other laws, the conflict will be resolved in favor of the laws of the State of Michigan. All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys' fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental and/or consequential damages.
10. GENERAL: By participating in the Promotion, entrants agree to these Official Rules and the decisions of Mercury, which are final and binding in all matters and all respects relating to this Promotion. This Promotion is void in Alaska, Hawaii and Puerto Rico and wherever else prohibited by law. Acceptance of a Prize constitutes the winner's consent to the use of his/her name, biographical information, photograph, and/or likeness for advertising and publicity purposes in any and all media as determined by Sponsor without further compensation, except where prohibited by law. All federal, state and local laws and regulations apply. All entries and/or materials submitted become the property of Sponsor and will not be returned.
